Definition

Company:   means Himaland Adventure Holiday Pvt. Ltd. based in Kathmandu, Nepal registered (no. 12264/056/057) in the Office of Company Registrar and licensed (no. 511/063) by the Department of Tourism, Government of Nepal as a tour operator hereinafter referred to as Company.

Clients:  means those persons, firms or companies who book the Tours from the Company;

Tours:  means any holiday and other travel arrangements whatsoever which are sold by the Company to Clients.

Services:   means the services required in operation of the Tour to be operated by the Company or procured and/or provided by the Supplier to Company and its Clients and referred to in this policy.

Confidentiality of Personal Data

The company shall use required personal data of the clients only for the purpose of conducting the booked tours among the supplier chain, regulatory bodies, local and government authorities and shall keep the personal data private and confidential and shall not use, copy or disclose to any irrelevant third party.

Reciprocally, the clients also shall not disclose the company’s confidential data/ information that may harm the company and it’s personnel. Information and data about the company besides those available on open sources which clients may come to know in the course of communicating and booking the tours are deemed to be confidential.

 Insurance

The Tour price does not include Clients’ travel, medical and evacuation or personal insurance. For your safety and protection, we highly recommend that you purchase insurance policy covering your personal medical expenses, emergency issues and other travel related needs. If Clients do not have the policy already and need info/ assistance, the company can advise them.

Note:

*  Himaland never had to do any major changes on the programmed itinerary or Tour programs in our last 25 years of operations. On rare occasions, some minor changes were made due to some conditions beyond our control (Force Majeure). 

 * We never have any dispute with our clients leading to the court of law or any regulatory body or business ethic council.

Limitation of Liability

Himaland Adventure Holiday Pvt. Ltd., later referred to as Himaland,  its owners, agents and affiliated companies act only as agents for hotels, transportation companies, land operators, airlines companies  and suppliers of travel services and assume no liability in connection with the operation or service of any transportation vehicle or hotel which may be used for services to Himaland clients. Himaland and its operators and agents will assume no liability for injury, damage, loss, accident, delay, irregularity or additional costs resulting directly or indirectly from any of the following causes: weather, natural calamities, failure of any means of transportation to adhere to schedules, quarantines, strikes, civil disturbances, theft, government regulations, or changes in transport and lodging beyond our reasonable control. Himaland reserves the right at any time, either prior to or after departure,  in its good-faith discretion, change or reschedule  any trip, including but not limited to the right to alter or omit any part of the itinerary, to substitute hotels or guides, or change any means of conveyance without notice and without allowance of refund, with the liability of increased costs – if any – to be borne by the clients. Himaland reserves the right to change any itinerary at any time when it is deemed appropriate for the safety of the clients or to comply with government restrictions.
